Abstract

Istihsan is a proof of Shariah widely used in Islamic law in matters of worship, muhamalat (trade), family and other matters of fiqh. A tool, a method for solving new problems arising in connection with the development of society and the development of science and technology. It refers to the object of study, the complex subject of the science of usul al-fiqh. At the same time, the role of istihsan, based on the Koran and Sunnah, is very important in realizing the goals of Sharia. To understand the practical meaning of istihsan, examples from modern problems are given.

The article analyzes the opinions of scholars and religious imams on the issue of istihsan as a guide in making religious judgments. The disagreements between them are identified, their arguments and scientific justifications are differentiated. One of the goals of the article was to compare the definitions given by many scholars with the evidence of istikhsan, to find points of contact between their definitions, and also to determine the evidentiary value of istikhsan in usul al-fiqh. The article summarizes the definitions of terms related to istikhsan by scholars of different sects. In addition, the study found that the definition of a certain term does not belong to Imam Abu Hanifa. As a result of the study, having analyzed the definitions and explanations given to prove the istikhsan of the sects, it was concluded that disagreements between the sects took place only at the linguistic level. As a result, it was established that there was no disagree- ment among scholars within the framework of the argumentation of istihsan, and that the method of istihsan was used by scholars of all sects in solving fiqh and practical problems.
